Clean Air Zones are a key measure to address current concerns on air quality. London’s Low Emission Zone (LEZ) and London Mayor Sadiq Khan’s plans to accelerate and extend its Ultra Low Emissions Zone (ULEZ) are leading the way. Defra’s December 2015 air quality plans envisage Clean Air Zones for Birmingham, Leeds, Nottingham, Derby and Southampton. ClientEarth calls that an inadequate response to continuing breaches of EU air quality law, and will take the UK government back to court this summer. The House of Commons EFRA Committee has called for councils in “dozens” of other English cities to be given powers to establish and enforce Clean Air Zones, with pollution charging.

This workshop will take place against a backdrop of rapid political, constitutional and legal change. The UK’s referendum vote to leave the European Union will have direct impacts on all environmental laws in general, and on the enforcement of European air quality legislation in particular. Sadiq Khan and others are already calling for a new UK Clean Air Act, and proposals to introduce an Emissions Surcharge in London in 2017 followed by the ULEZ expansion and other proposals announced on 5 July 2016 are billed as “the toughest crackdown on the most polluting vehicles by any major city in the world”.

Local authorities are left to administer Air Quality Management Areas and Plans, and to address the increasing impacts of air quality issues in the planning system. Transport companies will be impacted by new controls and standards, and a variety of different regimes applying across the UK. The workshop brings together some of the leading experts in air quality to examine the legal context and framework for Clean Air Zones, the powers available to local authorities to introduce them, and the likely impacts of Clean Air Zones on significant sectors of industry such as transport.
